Zoek (1): Engelse wantoestanden

Behalve als methode voor opslag van gegevens, moet je in een archief ook iets kunnen (terug)vinden.

Maar wat als een archief daar niet aan voldoet? En, bovenal, wat als het daarbij om mensen gaat?

UK Border Agency

Vorige week werd bekend dat in Groot-Brittannië maar liefst ruim 100.000 mensen zoek zijn: de bevolking kortom van een flinke stad als Cambridge bijvoorbeeld. In een rapport van de Home Affairs Select Committee worden de werkzaamheden van de UK Border Agency (de Britse Immigratie-en Naturalisatiedienst) op diverse punten kritisch tegen het licht gehouden.
De dienst heeft het sowieso niet gemakkelijk de laatste tijd en kwam, ook sinds de bekendmaking van het rapport, anderszins negatief in het nieuws. Het was vergeten, zo bleek gisteren nog, de minister te vertellen dat sinds de zomer de grenscontroles aanzienlijk zijn verslapt.


Legacy-bestanden

In 2006 maakte de toenmalig minister bekend dat er een grote achterstand was ontstaan bij de dienst; tevens beloofde hij dat die over een periode van vijf jaar zou worden weggewerkt. De achterstand werd geschat op 400-450.000 aanvragen tot immgratie, being "electronic and paper records, which ... are riddled with duplication and errors, and include cases of individuals who have since died or left the country, or are now EU citizens."
Aan het eind van deze periode is gebleken dat het om 500.500 aanvragen ging, waarvan overigens nu het overgrote deel (455.00) is verwerkt. Uiteindelijk werd 36% van de aanvragen gehonoreerd; daarentegen is 8% van de mensen gedeporteerd. In 18.000 gevallen is een beslissing nog ophanden.

Restcategorie

Deze cijfers vertellen echter nog maar het halve verhaal (of zelfs iets minder), mede dankzij een puur administratieve oplossing. De categorie 'other' - dat wil zeggen duplicaten, fouten of 'controlled archive' - telt namelijk inmiddels 268.000 gevallen, oftewel 56 % van het totaal van de legacy-bestanden.
Binnen deze groep groeide met name het aantal achterstallige asielaanvragen in het zogeheten 'controlled archive' gedeelte sinds november 2010 spectaculair: van 18.000 naar 98.000 gevallen in september 2011. Behalve om een grote groep asielaanvragen, gaat het tevens om nog eens ca. 40.000 gevallen van andere vormen van immigratie (die in 2009 alsnog door de dienst werden toegevoegd).

Steekproef

Binnen deze groep van 40.000 is een nadere steekproef genomen.

23. The UK Border Agency had also assessed a sample of 800 files. Of these, 65% pre-dated 2003, with some going back to 1983. They related to family claims (dependant spouses or other relatives seeking leave to remain), students and other types of migrant who were seeking to extend some kind of temporary leave to visit the UK.
For 85% of them, nothing further was known: there were no further applications to which they could be linked, nor had any representations been made about their application.
Of the remaining 15%, most had had their initial applications refused but had subsequently submitted more information or another application. We were told: "It is quite likely that a number of those people will have gone on to resolve their case in some way. They may well have made another application that was successful. They may well have left the country. My suspicion is that we will find, as we did with the general legacy cases, many of these cases are resolved".

Aan de hand hiervan zijn er 26.000 gevallen alsnog toegevoegd aan het archief. Dat telt nu 124.000 dossiers, oftewel een kwart van het totaal.

"Controlled archive"

In het 'controlled archive' belandden uiteindelijk die gevallen of dossiers 'which are placed in the archive when every effort to track an applicant has been exhausted' - het bovenstaande getal van 124.000 dus. 'The cases are checked against watchlists for a period of six months before they are considered to have been 'concluded'. Als iemand, na plaatsing binnen dit archief, niet binnen zes maanden alsnog opduikt wordt zijn dossier afgesloten. De overgang van semi-statisch naar statisch is dan een feit.
Met andere woorden: deze mensen zijn binnen de samenleving zoek, leven al dan niet ondergedoken of zijn weer uit het land vertrokken. Enig zicht op hen ontbreekt echter hoe dan ook. De facto betekent dit een amnestieregeling via de achterdeur, zo werd in sommige delen van de pers al geconstateerd aan de hand van het vorige verschenen rapport.

'Lost applicants'

25. Whilst we appreciate the difficulties involved in tracing people with whom the Agency have lost contact, usually for a period of several years, it is clear that the controlled archive has become a dumping ground for cases on which the Agency has given up. The controlled archive has increased significantly as the deadlines for the legacy backlog and the migration case review have approached. From 18,000 files in November 2010, the archive now contains 124,000 files, roughly equivalent to the population of Cambridge. With the end of the legacy backlog and review of the outstanding migration cases, we see no reason why the size of the controlled archive should increase further. We recommend that the Agency produce clear and specific guidance on the controlled archive which covers:

- how often the files will be reassessed;
- how many staff will work on reassessing files in the controlled archive;
- and, when, if ever, files will be closed without the applicant being located.
Het archief als eufemisme

'The Committee has recommended that guidance be produced on the management of the controlled archive and has stated with conviction that any further rise in the number of files transferred to the archive will be considered a failing on the part of the Agency.'
Onder het kopje 'Language and terminology' in zijn persbericht geeft het HASC tevens nog een andere aanbeveling: 'The Committee objects to the Agency’s use of the euphemistic term “controlled archive” to describe the applicants with whom it has lost contact.

26. We also object to the term 'controlled archive'. It is another instance of a bureaucratic term which hides the true nature of a government department's activity and is designed to deflect attention away from it. The controlled archive would be more appropriately referred to as an archive of lost applicants.

Ook interessant Otto. Het zou me niets verbazen als we binnenkort in de COA-soap hier ook nog dit soort dingen zullen horen.
Wat ik alleen niet snap is het stukje over "amnestieregeling via de achterdeur." Die mensen zijn toch nog altijd illegaal (ze hebben "geen papieren", zoals Tos en Otje)
Waar zit die amnestie dan in?

Klopt. In een eerste poging om de achterstanden snel weg te werken, heeft men 161.000 tijdelijke visa uitgedeeld aan mensen die 6-8 jaar in de procedure zaten ipv de gebruikelijke 10-12 jaar. De Engelse (rechtse) pers - en niet alleen zij - redeneert bovendien dat wanneer je geen mensen in grote aantallen terugstuurt (wat uiteindelijk dus met slechts 8 à 9 % gebeurd is), je feitelijk de deur openzet.
